Terms of instruction

These terms govern every filing and memorandum we accept. Instructing us, paying a deposit, or sending papers after a written scope constitutes acceptance.

Parties

Cuspatevanta, of 14 Dymoke St, Birmingham B12 0TA, United Kingdom. Contact: [email protected], +44 7597 005523. The client is the person named on the scope.

1. What we do

We prepare document packs and lodge digital nomad visa applications with destination-country authorities, consulates and visa centres, against criteria those authorities publish. We do not guarantee a grant. A visa decision is always the authority’s. We do not provide advice on entering or remaining in the United Kingdom and we are not regulated by the Office of the Immigration Services Commissioner.

2. Fees and payment

Professional fees are those published on the Filing page on the date of instruction, confirmed in the scope. Fifty per cent is due on instruction; fifty per cent on lodgement. Disbursements (visa fees, VFS, FCDO, translators, couriers) are billed at cost. Overdue invoices attract 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998 after 30 days.

3. Your papers

You warrant that documents and statements you supply are true. If a refusal follows from a fact you withheld or a document you altered, the remaining fee is still due and we have no duty to refile. If a refusal follows from an error in a document we drafted, we refile that destination once at no professional fee; disbursements remain yours.

4. Cancellation

You may cancel in writing before lodgement. Work already done is billed at £140 per hour against the deposit, with a minimum of the eligibility memorandum fee. After lodgement, professional fees are earned. Consumer cooling-off does not apply to services you asked us to start during the 14-day period.

5. Liability

Our liability for any claim arising from an instruction is capped at the professional fees paid on that instruction. We are not liable for lost income, delayed travel, or a change in published immigration rules after lodgement. Nothing excludes liability for death, personal injury, or fraud.

6. Law

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction. If a clause is unenforceable, the rest remains.
